Samsung Galaxy 10.1 Face Halt On Sales In US

 

After yesterday’s judge’s order to halt sales of Samsung Galaxy Tab 10.1 today the sale of the tablets are halted. The Court Considers that Samsung considers the South Korean tech giant illegally copied the design of the popular iPad which Apple’s claimed in a case. Judge, Koh ordered Apple to post a $2.6 million bond in case it ultimately loses the case. Judge also added that:

[quote]Although Samsung has a right to compete, it does not have a right to compete unfairly, by flooding the market with infringing products [/quote]

There’s answer on this from Samsung’s side and it reads as below:

[quote]Apple sought a preliminary injunction of Samsung’s Galaxy Tab 10.1, based on a single design patent that addressed just one aspect of the product’s overall design. Should Apple continue to make legal claims based on such a generic design patent, design innovation and progress in the industry could be restricted[/quote]

Now Samsung have option to redesign it like it did in Germany by introducing Galaxy Tab 10.1N but Samsung will likely seek to appeal Koh’s ruling to a federal appeals court in Washington, DC, which has exclusive jurisdiction over intellectual property disputes.
